Misbehavior before the enemy Tom, I understand, by definition, the CinC cannot not be guilty of promulgating surrender orders throughout the Afghanistan theatre. Interesting to think, however, if the orders spilled from just one military paygrade below CinC then the whole of the UCMJ might come in to play.
