For reference, the above message is a reply to a message where: Stated they wouldn’t press charges as Biden is a sympathetic well meaning elderly man with a poor memory “ that would be assessed the same in a court trial. The impact of this is yet to be determined, but I found it astounding. A special counsel wrote of a sitting president running for re-election: "We have also considered that, at trial, Mr. Biden would likely present himself to a jury, as he did during our interview of him, as a sympathetic, well-meaning, elderly man with a poor memory," Hur wrote in the report. "Based on our direct interactions with and observations of him, he is someone from whom many jurors will want to identify reasonable doubt. It would be difficult to convince a jury that they should convict him—by then a former president well into his eighties—of a serious felony that requires a mental state of willfulness." A jury would not convict anyone of his age of almost any crime after seeing the elderly man, with a poor memory, with no state of willfullness. Unbelievable. Confirms my position to refuse to vote for either Trump or Biden. How sad that in a nation of 360 million or so people that the choice may be reduced to these two individuals. |
