The offshore wind project off of Virginia Beach is now being challenged in a planned lawsuit.
In November two environmental organizations (C-Fact & Heartland Institute) served the required 60 day notice of intent to sue the Bureau of Ocean Energy Management (BOEM) and the National Marine Fisheries Service (NMFS), a sub-agency of the National Oceanic and Atmospheric Administration (NOAA). This lawsuit will allege deficiencies in the govt. reviews regarding the critically-endangered North Atlantic Right Whales. Thus, there are pending court challenges against NOAA's views, potentially undercutting the NOAA paragraph that Joe quoted.
